Terms of Service

These Terms of Service ("Terms") govern access to and use of the Dabs Collectibles website, applications, and related services (collectively, the "Platform") operated by Dabs Collectibles ("Dabs Collectibles," "we," "us," or "our"). By accessing or using the Platform, connecting a wallet, creating an account, listing an item, or completing a purchase, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Platform. We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance of the revised Terms.

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to form a binding contract. You may not use the Platform if you are barred under applicable law or if we have suspended or terminated your access.

The Platform is not directed to children. We do not knowingly collect personal information from anyone under 18.

You may sign in with a magic link sent to your email address and/or connect a compatible cryptocurrency wallet for payments and escrow flows. You are responsible for:

• Maintaining control of your email inbox and any device used to complete sign-in;
• Securing your wallet, seed phrase, and private keys (we never ask for your private keys);
• All activity that occurs under your account or connected wallet;
• Keeping profile, shipping, and contact information accurate and up to date.

Linking a wallet to your account does not transfer custody of assets to us. Wallet connection is used to identify you for marketplace transactions as described in the product.

Dabs Collectibles provides an online venue for peer-to-peer sales of physical trading cards, slabs, and related collectibles. We are not the buyer or seller in your transactions unless explicitly stated. Sellers offer items; buyers purchase through the Platform's checkout and escrow flow.

We may remove listings, suspend accounts, or withhold escrow releases when we reasonably believe these Terms, our Marketplace Guidelines, or applicable law have been violated.

Sellers represent and warrant that:

• Each listing is for a physical card, slab, or sealed product they actually own and have the right to sell;
• Photos and descriptions are accurate as to identity, condition, grading (if applicable), and defects;
• Items are authentic and not counterfeit, altered without disclosure, stolen, or otherwise unlawfully obtained;
• They will ship within the timeframe shown at listing or checkout (currently within three business days unless otherwise stated).

Prohibited items include counterfeits, stolen goods, items you do not possess, listings intended to mislead buyers, and any item illegal to sell or ship in the buyer's or seller's jurisdiction. See the Marketplace Guidelines for listing standards.

When you purchase on the Platform, payment is typically collected in supported digital assets (for example, SOL) and held in escrow until the order progresses through the delivery workflow described in the product (for example: seller ships with tracking, buyer confirms delivery or tracking is verified, followed by a buyer-protection window during which disputes may be opened).

This description explains how the Platform is designed to operate. It is not a guarantee of any particular outcome, timeline, or recovery of funds. Escrow mechanics may use a custodial platform wallet or other infrastructure and may differ in preview, staging, or development environments.

Released funds (net of applicable fees) are sent to the seller's designated wallet or account as configured in the product. On-chain transfers are generally irreversible once confirmed.

Platform fees, network fees, and any swap or token-related mechanics are disclosed at checkout, in listing tools, or in product documentation (including DABS token policy). Fees may change with notice on the Platform. You are responsible for blockchain network fees associated with your wallet transactions.

Sellers must ship using a trackable carrier when required by the order type or Platform rules. Buyers should provide accurate shipping information. Once escrow funding is confirmed, cancellation rights are limited and governed by the order state and these Terms.

We may cancel or refund orders when required by law, when fraud is suspected, when a listing violates these Terms, or when operational errors occur.

Buyers may open a dispute within the buyer-protection window described in the product (for example, within 24 hours after delivery confirmation when no dispute was already opened). Parties should upload evidence (photos, tracking, messages) through the Platform when available.

We may review disputes and decide whether to release escrow to the seller or refund the buyer based on Platform records and evidence. Platform decisions for on-platform escrow are final as between you and us, without prejudice to rights you may have against the other party outside the Platform.

Chargebacks or payment reversals may not be available for on-chain payments in the same way as card payments. See Crypto & Risk Disclosures.

You retain ownership of content you submit (photos, descriptions, profile text). You grant Dabs Collectibles a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content solely to operate, promote, and improve the Platform (including thumbnails on listings and order pages).

The Platform, branding, software, and documentation are owned by Dabs Collectibles or its licensors. You may not copy, scrape, reverse engineer, or misuse our IP except as allowed by law or written permission.

You agree not to:

• Circumvent escrow, fees, or identity checks;
• Engage in fraud, money laundering, or sanctions violations;
• Harass other users or our staff;
• Upload malware or attempt unauthorized access;
• Use the Platform for investment advice, securities offerings, or unlawful gambling;
• Misrepresent affiliation with Dabs Collectibles.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Dabs Collectibles is not a bank, broker-dealer, investment adviser, or money transmitter unless separately licensed and identified as such. We do not provide investment, tax, or legal advice. Digital asset values are volatile. See Crypto & Risk Disclosures.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DABS COLLECTIBLES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You will defend, indemnify, and hold harmless Dabs Collectibles and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your listings, sales, purchases, content, tax obligations, violation of these Terms, or violation of any law or third-party rights.

These Terms are governed by the laws of the State of [TBD], without regard to conflict-of-law rules, except where mandatory consumer protection laws of your residence apply.

Except for small-claims matters or injunctive relief, disputes will be resolved by binding arbitration or courts located in [Venue — TBD], as specified in a future update after counsel review. You and we waive jury trial to the extent permitted by law.
